Australian work rights explained

The Australian government allow overseas people to enter Australia for various work purposes. Depending on the applicant's circumstance they will be granted either a temporary or permanent visa.

Australian Temporary Work permits include the following:

Australian Visitors (tourists) visa

Please note - there are no rights to work if you are travelling to Australia on a visitor visa (that is, as a tourist or family visitor).

Australian Academic Staff visa

The Visiting Academic visa provides for a temporary stay for academics to visit Australia to observe or participate (without remuneration other than for living expenses and travel costs) in research projects at the invitation of an Australian tertiary institution or research organisation.

The Visiting Academic visa is not intended for academics receiving remuneration (for example, a fellowship, salary, stipend, grant, scholarship, award or allowance (other than towards living expenses)) from the inviting institution. Such persons should, as appropriate to their circumstances, be assessed against visa 418 Education or Student (Temporary) visa.

Overseas tertiary graduates essentially seeking work experience opportunities in an Australian tertiary or research institution may be assessed against visa 442 Occupational Trainee.

Stay period
You can stay in Australia for a maximum of 12 months or for the period of stay covered in the invitation, whichever is the earlier date.

Work rights
Condition 8107 and 8103 work limitation is attached. This means that you must not ● cease to undertake the activity in relation to which the visa was granted; or engage in an activity inconsistent with the activity in relation to which the visa was granted; or engage in work for another person or on your own account inconsistent with the activity in relation to which the visa was granted, and receive a salary without permission from the department.

Letter of invitation
You will need to provide a letter of invitation from the Australian tertiary institution or research institution.
● The letter of invitation should indicate: the period for which the invitation is extended, details of the applicant's proposed activities in Australia , and the nature and amount of any proposed payments by the institution to the applicant, if any.
You will also need to provide a statement from your home institution which confirms the invitation to visit an Australian institution and that your leave from your usual academic appointment will be granted.

Australian Backpackers (working holiday makers) visa

The Working Holiday Program provides opportunities for people between 18 and 30 to holiday in Australia and to supplement their travel funds through incidental employment.

The visa allows a stay of up to 12 months from the date of first entry to Australia, regardless of whether or not you spend the whole time in Australia.

You are allowed to do any kind of work of a temporary or casual nature, but work for more than three months with any one employer is not permitted.

From 1 November 2005, Working Holiday Makers who have worked as a seasonal worker in regional Australia for a minimum of three months while on their first working holiday visa, will be eligible to apply for a second Working Holiday visa and stay for a further 12 months.

Australia has reciprocal Working Holiday maker arrangements in effect with the United Kingdom, Canada, the Netherlands, Japan, Republic of Ireland, Republic of Korea, Malta, Germany, Denmark, Sweden, Norway, the Hong Kong Special Administrative Region (HKSAR) of the People's Republic of China, Finland, the Republic of Cyprus, France, and Italy, Belgium, Estonia and Taiwan.

If you intend to apply for a second Working Holiday visa, you will need to provide evidence that you have worked for a minimum of three months as a seasonal worker in regional Australia while on your first working holiday visa. Before commencing seasonal work in a regional area, you should obtain a copy of the employment verification form from your nearest DIMIA office, or from the forms section of the DIMIA website - www.immi.gov.au

Australian APEC Travel Card visa

Travel help for business people from Asia-Pacific Economic Cooperation (APEC) economies.

The APEC Business Travel Card cuts though the red tape of business travel, and gives accredited business people pre-cleared entry to participating APEC economies. Card holders enjoy:

  • pre-cleared short-term entry to participating economies (no need to individually apply for visas or entry permits each time you travel).
  • multiple entry to these economies (cards are valid for three years), and
  • faster immigration processing on arrival via access to fast-track entry and exit through special 'APEC' lanes at major airports.

Who is eligible
IIf you want to apply for the card, you need to be a business person who:
● holds a valid passport of a participating economy; travels frequently to conduct trade and investment
● activities within the APEC region; and has never been convicted of a criminal offence.

Australian Short business visits visa

For business visits of less than three months.
The Business (Short Stay) visa (subclass 456) allows the bona fide business person to make a visit to Australia of up to three months to conduct business. Examples of appropriate activities include a conference, negotiation or an exploratory business visit, but do not include acting or music performance or commercial film making.

A single-entry or multiple-entry visa may be issued.

In many countries, you can obtain a Business (Short Stay) visa at the same time you purchase an airline ticket. Ask for a Business Electronic Travel Authority (ETA) for Australia or apply on line at www.immi.gov.au .

Australian Longer business visits visa

For business visits of more than three months.
For longer stays, the Temporary Business Entry (Long Stay) visa caters for business visits of up to four years for:

  • personnel (executives, managers and specialists) for companies operating in Australia;
  • personnel from offshore companies seeking to establish a branch in Australia, participate in joint ventures, or fulfil a contract awarded to an offshore company;
  • personnel coming under a labour or Invest Australia Supported Skills agreement.
There are special arrangements for employers in regional and low population growth areas across Australia . Regional arrangements assist employers who may not otherwise be able to meet minimum skill and salary requirements for employees.

Where a Regional Certifying Body supports the employer's nomination, an overseas worker may be recruited to fill a position in regional areas which falls below the normal minimum skill or salary level.

Australian Domestic Staff (Diplomatic or Consular) visa

The Domestic Worker (Diplomatic or Consular) visa allows for a temporary stay for full-time private adult domestic workers of diplomats and consular representatives posted to Australia. The domestic worker must be outside of Australia when applying for their first 426 visa.

Stay period
You can stay in Australia for a maximum of 2 years or for the term of the representative's posting, whichever is the earlier date.

Work rights
You have full permission to work with condition 8107 and 8110 work limitation attached. This means that you:
  • can only work in the household of your employer
  • can only undertake domestic duties
  • cannot work for another person or for yourself
  • must seek permission from the Department of Foreign Affairs and Trade (DFAT) if you wish to cease working for your employer or remain in Australia after your employer has permanently left Australia .

Australian Domestic Worker (Overseas Executive) visa

The Domestic Worker (Overseas Executive) visa allows for a temporary stay for persons to be employed as full-time domestic workers by an executive who is in charge of an Australian office of an overseas organisation, and who is a holder of certain categories of the Temporary Business visa 457. An example of a 457 visa category that is not allowed to sponsor a domestic worker is the 457. IE FAO visa.
Australian government policy does not, in general, allow domestic workers temporary entry to Australia. However, this visa recognises the representational and entertainment responsibilities of certain executives while working in Australia.

You must have turned 18 and had experience as a domestic worker.

Stay period
You can stay in Australia for a maximum of 2 years or for the term of the executive's stay, whichever is the earlier date.

Work rights
In Australia you are required to be employed in accordance with the standards for wages and working conditions provided for under relevant Australian legislation and awards.

You have full permission to work with condition 8107 work limitation attached. This means that you must not :

  • stop working for the employer who sponsored you for the visa either by becoming unemployed or changing employer,
  • work in a position or occupation that is inconsistent with the nominated position, and
  • work for another person or for yourself while working for the sponsoring employer (ie. undertaking secondary employment).
Sponsorship
In all cases, the executive must provide a written undertaking not to recover from you any of their travel expenses or financial support.
Full labour market testing may be required. The executive has to prove that they have been unable to find a suitable person in Australia for the relevant position or that there are compelling reasons for employing you.

Australian Educational/Research Staff visa

The Education visa allows the temporary entry/stay in Australia of qualified people to join educational institutions or fill teaching positions unable to be filled from the Australian labour market. This can be for academic or lecturing positions, research positions or for teaching positions at private or public schools and colleges.

Sponsorship by an Australian education/research institution is required for all applicants whose total stay in Australia will be greater than 3 months or those applicants currently holding a student visa. The sponsorship application must be lodged and approved in Australia before the visa application can be assessed.

The work condition on your visa does not allow you to change employer or occupation.

To change employer, your new prospective employer will be required to be an approved sponsor and you will need to apply for a new visa. If you are considering changing, or have already changed employer or occupation without permission, you should contact the department immediately to discuss the matter.

You can apply for an Education visa if you:

•  have an approved sponsorship by an Australian education or research institute, for stays    of three months or more,
•  have been appointed to a full-time position at an Australian education or research    institution, and
•  labour market testing requirements have been met,
•  you are adequately remunerated in the position, having regard to Australian conditions    and levels of remuneration,
•  you are employed or engaged in Australia in accordance with relevant Australian    legislation and awards,
•  your employment in the position would benefit Australia,
•  have suitable qualifications, skills and experience for the position to which the    application relates,
•  are of good health and character, and
•  have no limitations on making an application if applying in Australia
.

Australian Employee Exchange visa

The Exchange visa allows for the temporary stay of skilled people wanting to come to Australia to broaden their work experience and skills under reciprocal arrangements, which allow Australian residents similar opportunities overseas.
It includes people seeking entry under certain bilateral exchange agreements.

Staff exchanges
For a staff exchange:

  • the position must be skilled,
  • an Australian must have an opportunity for experience in a reciprocating overseas organisation, and
  • the exchange must benefit both you and the Australian, and
  • you should provide statements from both the 'reciprocating organisation overseas' and the organisation in Australia
Bilateral country agreements.

For a country to country agreement:
  • the requirements of the agreement must be met,
  • the competent authorities in Australia and the other country must agree to your stay, and
  • you must provide evidence of this agreement.

Stay period
You can stay in Australia for a maximum of 2 years or for the period of the exchange, whichever is the earlier.

Work rights
You have full permission to work with condition 8107 work limitation attached. This means that you
must not:

  • stop working for the employer who sponsored you for the visa either by becoming unemployed or
  • changing employer,
  • work in a position or occupation that is inconsistent with the nominated position, and
  • work for another person or for yourself while working for the sponsoring employer (ie. undertaking secondary employment).

Australian Entertainers visa

The Entertainment visa is for people in the entertainment industry who intend to undertake work in film, television or live productions in either a performance or behind-the-scenes role.

Note: do not apply for a Business (Short Stay) visa (subclass 456) or subclass 977 if you will be acting or undertaking music performance or commercial film making.

All people from overseas  wishing to work in the entertainment industry need to obtain an Entertainment visa.

Entry of overseas entertainers
Australia's policy regarding the temporary entry and stay of entertainment industry professionals seeks to facilitate the Australian community's access to a wide range of social and cultural events and activities without jeopardising the employment of Australians in the industry.

Sponsorship is required regardless of the period of stay unless the entertainer seeks to enter Australia under a country-to-country agreement.

For all commercial productions, sponsors need to consult within the entertainment industry prior to lodging applications with the department.

Sponsors should undertake consultation with the appropriate union in order for the department to be satisfied that a net employment benefit to the entertainment industry will occur.

A certificate from the Department of Communications, Information Technology and the Arts (DCITA) is also required for performers in film and television productions.

Foreign Government Agency Staff visa for Australia

The Foreign Government Agency visa provides for a temporary stay in Australia for persons who are:

•  to be employed as a representative of a foreign government agency    and who will not be accorded official status in Australia by the    Department of Foreign Affairs and Trade (DFAT), and therefore are not    eligible for a Diplomatic visa; or
•  to be paid by a foreign government, working as a language teacher in    an Australian school; or
•  under an agreement between Australia and another country.

It is not intended for:

DFAT-accredited representatives of foreign governments or foreign government agencies [eg. diplomats, consular officials (including service staff employed by a diplomatic mission) and UN agency executives].

Such persons are entitled to the grant of a Diplomatic (Temporary) visa,

•  representatives of foreign governments or government agencies     seeking a visa for business purposes, rather than employment. Such     persons should apply for, and be considered against provisions of the     relevant Temporary Business Entry visa,

•  domestic workers employed privately by Diplomatic (Temporary) visa     (subclass 995) holders. Such persons should apply for, and be     considered against the provisions of the Domestic Worker visa     (subclass 426).

Stay period
You can stay in Australia for a maximum of 4 years or the period of stay approved by your Foreign Ministry or the approved period of sponsorship, whichever is the earlier date.

Work rights
You have full permission to work with condition 8107 attached. This means that you must not :

•  stop working for the employer who sponsored you for the visa either by becoming    unemployed or changing employer,
•  work in a position or occupation that is inconsistent with the nominated position, and
•  work for another person or for yourself while working for the sponsoring employer (ie.    undertaking secondary employment).

Sponsorship is not required if :

•  your stay is less than 3 months,
•  you are applying under a country to country agreement,
•  you are a senior representative of certain organisations.

Statement from foreign government/agency
You will need to provide a statement from your Foreign Ministry or relevant international agency detailing support for your visa application. The statement is to confirm:

•  your period of stay
•  that you are a representative of your Foreign Government or agency
•  why it is necessary to employ you and the benefits that employment will have for    Australia .

Foreign teachers visa for Australia

Foreign teachers employed by a foreign government agency to work in an Australian school require statements from the:

•  Australian school or educational authority supporting your intention to work in an    Australian school, and
•  Home government's Foreign Ministry supporting your intention to work as an employee    of that government.

Lecturers (Public Events) visa for Australia

The Public Lecturer visa is intended for persons whose usual occupation is associated with appearing and lecturing regularly in public, rather than persons employed by a single university or institution, and whose main purpose in seeking a visa is to follow that occupation, usually in response to an invitation from an organisation in Australia.

Stay period
You can stay in Australia for a maximum of 2 years or for the period of the public lecturing, whichever is the earlier date.

Work rights
You have full permission to work with condition 8107 attached. This means that you must not :

•  stop working for the employer who sponsored you for the visa either by becoming    unemployed or changing employer,
•  work in a position or occupation that is inconsistent with the nominated position, and
•  work for another person or for yourself while working for the sponsoring employer (ie.    undertaking secondary employment).

Media and Film Staff visa for Australia

The Media and Film Staff visa provides for the temporary stay of:

  • media and film staff approved under a country-to-country agreement to which Australia is a party, or
  • television or film crew, including actors, production and support staff and still-photographer, involved in the production of documentary programs (or commercials) exclusively for use outside Australia. If the program will be shown in Australia, these persons should apply for an Entertainment Visa.
    Note: Do not apply for a Business (Short Stay) visa (subclass 456) or subclass 977 if you will be acting or undertaking music performance or commercial film making.

Professional media staff members of overseas news organisations  (print, radio, TV or film media) assigned to Australia as accredited representatives of that organisation (eg. as their foreign correspondent) should apply, and be assessed against criteria, for a Temporary Business Entry (TBE) visas 456 (up to 3 months) and 457 (up to 4 years).

Stay period
You can stay in Australia for a maximum of 2 years or for the period determined by your purpose of entry.

Sponsorship
Sponsorship is required if your stay is for more than 3 months.

Work rights
You have full permission to work with condition 8107 attached. This means that you must not :

  • stop working for the employer who sponsored you for the visa either by becoming unemployed or changing employer,
  • work in a position or occupation that is inconsistent with the nominated position, and
  • work for another person or for yourself while working for the sponsoring employer (ie. undertaking secondary employment).

Statement of support
A statement of support provided by the relevant organisation is required for:

  • stays of up to 3 months, or
  • if the organisation is not represented in Australia ,or
  • if entering under a country-to-country agreement.

You need to provide a statement of support on letterhead from the relevant overseas news organisation. The statement is to confirm the following:

  • that your assignment to Australia is as an accredited representative (ie. media/film correspondent or reporter) of that news organisation
  • a brief description of the nature of the position
  • details of your qualifications, experience and current position in the organisation
  • intended length of stay in Australia and salary and allowances to be paid
  • whether the organisation is already represented in Australia.
Overseas Doctors visa for Australia

The Australian Government has launched a package of measures designed to address Australia's  short and longer term medical workforce needs. The package includes a number of initiatives that will increase opportunities for appropriately qualified overseas trained doctors to enter the Australian medical workforce.

Overseas-trained doctors (OTDs) or former overseas medical students (that is, persons who were not Australian citizens or permanent residents when they commenced study for their medical degree in Australia ) can come to Australia on either a temporary basis or as permanent skilled migrants through the General Skilled Migration Program or the employer sponsored migration programs. To be granted a temporary visa, the relevant state or territory medical board must have recognised the applicant's qualifications and must have conditionally approved the applicant for registration to practise as a medical practitioner in that state or territory. To be granted a permanent visa, full medical registration is required.

Special assistance for communities in rural and regional Australia

There are special provisions under the Medical Practitioner visa program to help communities in rural and regional areas of Australia. A doctor who wishes to establish a sole person practice in a regional area may be self-employed on a fee-for-service basis. In these cases, the doctor may be sponsored by a local government body, community health agency or State government department.

Communities in Regional Australia may sponsor a doctor for permanent residence under the Regional Sponsored Migration Scheme.

New Zealand Family Visitors Visa for Australia

Visa 461 allows a temporary stay of family unit members of New Zealand citizen Special Category visa holders.

There are no visa conditions.

Nurses visa for Australia

Nurses are currently in high demand in Australia . There are excellent career opportunities whether you want to emigrate to Australia, or just stay for a few years.

Whether you have a high level of skills and experience or need to gain additional skills, there is a visa to suit you.

Most visa applications for nurses receive priority processing.

You can come to Australia independently, and look for work, or arrange a job with an employer before you leave.

In Australia, to work as a nurse you need to be in good health and have a certain level of education and experience.

To determine whether you can work in Australia as a nurse, you will need to be assessed by either the Australian Nursing & Midwifery Council (ANMC) or the nurse regulatory body in the State or Territory in which you wish to work.

The ANMC's website has more information including links to State and Territory nurse regulatory bodies.

If you wish to work in a hospital or other health care area, you will also need to pass a health examination that includes a chest x-ray.

If you are sponsored by an employer as a Nurse

Employer Nomination Scheme

If you are less than 45 years of age and have three years training followed by three years relevant work experience, you may be eligible for a permanent visa under this scheme. This scheme is designed to help employers that have been unable to fill a vacancy from the Australian labour market or through their own training.

Labour Agreements
A Labour Agreement between an employer and the Australian Government allows an employer to recruit nurses on a permanent basis to fill vacant positions as they arise.

Regional Sponsored Migration Scheme
This scheme helps employers in regional or low population growth areas recruit  skilled overseas nurses on a permanent basis, when they are unable to fill vacancies from the local labour market. You must have the equivalent of an Australian diploma (two years full-time study) or higher to be considered under this scheme.

Skill Matching visa
This visa is for nurses whose skills are in demand and are seeking to be nominated by a State or Territory government or an employer. To qualify for this permanent visa, you must satisfy certain criteria for skills, age and English language ability.

Business (Long Stay) visa
This option allows a registered nurse to work temporarily in Australia for an approved business sponsor. You can stay up to four years with full work rights for yourself and accompanying family members.

Australian Occupational Trainee visa
An occupational trainee visa allows persons from outside Australia to undertake a supervised training program in Australia that is workplace-based and has been designed specifically to add to, or enhance, the person's level of practical skill in their present occupation or area of expertise.

To meet the criteria for approval for an occupational trainee visa, you will need to:

    • demonstrate that you are a genuine applicant for entry to Australia as an occupational trainee;
    • meet health requirements
      (this health requirement applies equally to all applicants for long-term temporary residence from all countries. The assessment takes into consideration information such as intended activities in Australia , length of stay and where you have been staying over recent years)
    • meet character checking requirements
      (all people who want to stay temporarily in Australia must be of good character. The test takes into consideration information such as criminal record and conduct.

Applicants should be aware that the grant of a visa is not guaranteed based on the approval of a nomination.

Visa issue is subject to the nominee meeting a number of regulation requirements for entry to Australia.

Visa conditions

Conditions that must apply to occupational trainee visa holders include:

    • condition 8102 which states: "the holder must not engage in work in Australia other than in relation to the holder's course of study or training" (for primary applicants);
    • condition 8101 which states: "the holder must not engage in work in Australia " (for secondary applicants); and
    • condition 8501 which states: "the holder must maintain adequate health insurance arrangements whilst the holder is in Australia ".

Conditions that may apply to occupational trainee visa holders include:

    • condition 8503: "The holder will not, after entering Australia, be entitled to be granted a substantive visa, other than a protection visa, while the holder remains in Australia";
    • condition 8516: "The holder must continue to be a person who would satisfy the primary or secondary criteria, as the case requires, for the grant of the visa".
Australian Professional Development Program visa

Overseas organisations interested in sending professional staff to Australia to undertake professional development training can now access the Professional Development visa scheme.

The visa is part of a scheme that:

  • allows Australian organisations to be approved as professional development sponsors; and
  • offers streamlined visa processing for visa applicants.
Australia Religious Worker visa

The Religious Worker visa (subclass 428) provides for the temporary stay for persons who will be full-time religious workers in Australia.

Religious work is work of a religious nature for which the applicant has had relevant religious training or may be undertaking training.

The religious work proposed must directly service an organisation's religious objectives. It would usually be religious work involved in:

  • providing spiritual leadership
  • conducting worship
  • teaching or guidance in religion
  • ministering, pastoral care or proselytising
  • undergoing religious training
    or
  • other high level specialist work in relation to the above.

The visa is not intended for people who wish simply to undertake work for a religious organisation. It must be for work that specifically requires a religious worker and not merely a religious adherent.

Agreements
To reduce the processing time, religious organisations may enter into an Agreement with the department, lasting 1-2 years, to bring religious workers to Australia . The department will advise interested organisations when an agreement can be arranged.

Stay period
You can stay in Australia for a maximum of 2 years or for the period sought by your sponsor, whichever is the earlier date.

Age
You would usually need to be 18 years or older to apply for the visa. If you are a religious trainee under 18 years of age, and an agreement is in place between the department and your sponsoring religious organisation, consideration may be given to your application if all other requirements are met.

Work rights
You have full permission to work with condition 8107 attached. This means that you must not :

  • stop working for the employer who sponsored you for the visa either by becoming unemployed or changing employer,
  • work in a position or occupation that is inconsistent with the nominated position, and
  • work for another person or for yourself while working for the sponsoring employer (ie. undertaking secondary employment).
Sponsorship
Sponsorship is required regardless of the period of stay.

A written undertaking is required regardless of the period of stay. The religious organisation is required to confirm that they are:

  • to meet all travel expenses to a place in a foreign country when the:
    • sponsorship ceases to be in force
      or
    • visa ceases to have effect, whichever is the earlier, and
  • not to seek to recover from you any expenditure incurred by you in relation to your travel to or from Australia , or in relation to your financial support in Australia.
Sports Competitors visa for Australia

The Sport visa allows for a temporary stay of amateurs or professional sports people who currently play at Australian national competition level or higher. The Sports visa is to improve the quality of a sport in Australia through participation in high-level competition and training with Australian residents.

However, sports people may also enter Australia on a variety of other visas depending on the circumstances of their proposed stay.

Trainee
If you will be participating in a structured training program you must be currently competing/coaching/instructing at the national level or higher in your home country. You do not need to be capable of competing/coaching/instructing at the national level in Australia .

Amateur
If you are applying as an amateur participant in a sporting event, then you must provide documentation that shows that you do not earn a living as a result of your sport, nor earn a significant sum of money from that sport. Many elite sports people engaging in what once may have been considered 'amateur' sports would have to demonstrate their income is from a means not related to their sport in order to be granted fee exemption.

Stay period
If you are sponsored the maximum period that you can stay is 2 years or the period of stay covered in the sponsorship (whichever is the earlier date).

If you are not sponsored the maximum period that you can stay is determined by your purpose of entry.

Work rights
You have full permission to work with condition 8107 attached. This means that you must not :

  • stop working for the employer who sponsored you for the visa either by becoming unemployed or changing employer,
  • work in a position or occupation that is inconsistent with the nominated position, and
  • work for another person or for yourself while working for the sponsoring employer (ie. undertaking secondary employment).
Letter of endorsement

To confirm that you are of current Australian national competition level or higher, a letter of endorsement is required from the national sporting body (or peak sporting body if no national body exists) in Australia of the sport concerned. Examples of national sporting bodies in Australia are the Australian Ice Hockey Federation, Soccer Australia and Australian Rugby Union.

Note: The letter of endorsement must be from a national body not State or Territory.

Sponsorship/Letter of invitation
Sponsorship and/or a letter of invitation may be required depending on the activity and the length of stay in Australia . Players, coaches, instructors and trainees must be sponsored.

Australian Special Programs visa

The Special Program visa (subclass 416) is designed to promote opportunities for persons to experience other cultures, to enhance international relations and to broaden the experience and knowledge of participants. It provides for persons to participate in youth exchange schemes, approved community-based non-commercial programs or to visit Australia as the holder of a Churchill fellowship.

The visa is not intended for people who wish simply to undertake work while on holiday. Only participants of an approved Special Program are eligible to apply for the Special Program Visa.

Stay period
You can stay in Australia for a maximum of 1 year or for the period sought by the organisation inviting you to Australia, whichever is the lesser.

Age
For youth exchange program participants, you need to be aged between 18 and 30 years.

Work rights
You have full permission to work with condition 8107 attached. This means that you must not :

  • stop working for the employer who sponsored you for the visa either by becoming unemployed or changing employer,
  • work in a position or occupation that is inconsistent with the nominated position, and
  • work for another person or for yourself while working for the sponsoring employer (ie. undertaking secondary employment).

Advice received from the Department of Employment and Workplace Relations (DEWR) is that any employment undertaken whilst participating on the Special Program, must be paid the appropriate award wage.

Sponsorship
Sponsorship is not required. However, you will need a letter of invitation from the approved organisation inviting you to Australia .

Australian Student visa

Australia's student visa program provides for the entry of overseas students who wish to undertake full-time study in registered courses in Australia.

All initial student visas granted do not provide permission to work in Australia.

Students and their dependants will only be able to apply for a student visa with work rights after they arrive in Australia and only after the student has commenced their course of study.
Generally, students and their dependants are limited to 20 hours' work per week while the student's course of study is in session.
